Gift Card Terms and Conditions
Titan Training Ground and the Pro Stores' Gift Card Terms and Conditions.

Titan Training Ground and Pro Store Gift Cards (Gift Cards) entitle the holder to goods/services equal to the value stated on the Gift Card or remaining after partial redemption.

Gift Cards are only redeemable within participating Titan Training ground training centres, Pro Stores in New Zealand, or online at titantrainingground.com/pro-store.

Gift Cards may not be exchanged (wholly or partly) for cash.

The value shown on a Gift Card includes GST.

Gift Cards are partially redeemable and any unused balance will remain on the Card and cannot be redeemed for cash.

If the Gift Card holder's order exceeds the amount of the Gift Card, the Gift Card holder will be required to pay for the difference in price between the value of the Gift Card and the retail price of the goods or services.

All Gift Cards sold at Titan Training Ground, Pro Store (including online at titantrainingground.com) or at third-party locations have a 365-day lifetime from the moment of purchase and expire once the 365 period has ended.

Should Titan Training Ground or the Pro Store suspect any fraud relating to a Gift Card, Titan Training Ground or the Pro Store may refuse to redeem the Gift Card until Titan Training Ground or the Pro Store is satisfied that no fraud has occurred.

Titan Training Ground and the Pro Store are not liable for lost/stolen Gift Cards. Please contact a Titan Training Ground training centre or Pro Store store immediately if your Gift Card has been lost/stolen.

Lost/stolen Gift Cards can only be replaced if satisfactory proof of purchase is provided and the Gift Card has not been redeemed.

Terms and Conditions of Ticket Sales.
Titan Training Ground operates as an agent for the venue, promoter, or event organizer (the "Seller") by providing ticketing services, which include the sale and distribution of tickets. The Site, titantrainingground.com, is owned and operated by Titan Training Ground to provide these services.
Please carefully read the Terms and Conditions before you purchase a ticket from Titan Training Ground. By purchasing a ticket, you are acknowledging and agreeing to abide by these Terms and Conditions. Any spelling, grammar, and punctuation errors have been corrected. The Terms and Conditions apply to both the sale of tickets and event attendance, and they relate to both the original purchaser and any subsequent ticket holders, meaning you. These Terms and Conditions do not intend to limit your rights under the Consumer Guarantees Act 1993.
Variation to Terms and Conditions
Titan Training Ground reserves the right to modify these Terms and Conditions by updating them. Any changes will only apply to ticket purchases made after the update.
Additional Seller Terms and Conditions
Each ticket is also sold subject to any additional terms and conditions of the Seller for the particular event ("Seller's Terms"). The Seller's Terms may be disclosed as part of the event information on Titan Training Ground’s website and at Titan Training Ground agents and outlets at the time of purchase. The Seller's Terms are also available from Titan Training Ground on request.
General Terms and Conditions
Titan Training Ground acts as an agent for the Seller in the sale of all tickets. As such, except as specified in these Terms and Conditions, all claims in connection with tickets or events are the sole responsibility of the Seller and, except to the extent required by law (including the Consumer Guarantees Act 1993), Titan Training Ground otherwise has no liability to you.
Refunds, exchanges and replacements
Subject to refund requests made in relation to refundable tickets (see the Refundable Tickets Terms and Conditions of Sale below);

Titan Training Ground will only offer a refund or exchange of a ticket if an event is cancelled, rescheduled or significantly relocated by the Seller (and you cannot or do not wish to attend the rescheduled or relocated event), or to the extent otherwise required by law (including the Consumer Guarantees Act 1993). You must apply for a refund within a reasonable time. Titan Training Ground does not offer refunds or exchanges as a result of a change in your personal circumstances.

If an event is cancelled, rescheduled or significantly relocated by the Seller, to the fullest extent permitted by law all liability is limited to the amount for which the ticket was purchased (including any fees or charges). Proof of purchase may be required for any refund or exchange. To the fullest extent permitted by law, neither Titan Training Ground nor the Seller will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.

Titan Training Ground will only replace lost, stolen, damaged or destroyed tickets if the authenticity of the ticket can be verified, including proof of purchase, and if you give reasonable notice before the event. Titan Training Ground may charge a reasonable fee for the replacement of tickets. Titan Training Ground may not replace tickets where placement is unallocated (general admission tickets).

You should carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at an event. You may also wish to consider taking out a relevant insurance policy to cover any losses in the event of cancellation, rescheduling or relocation.

In most cases, refunds will be automatically processed to the credit card originally used for purchase.
Refundable Tickets Terms and Conditions of Sale
If you have purchased Refundable Terms on your transaction and are unable to attend your booking due to unforeseen circumstances outside of your control you may be entitled to a refund – please see our full set of Refundable Terms and Conditions. To apply for a refund please contact our Refundable Tickets team. Should your reason for refund not be found in the Refundable Terms and Conditions above, please get in contact with our customer service team as per our standard Terms and Conditions of sale.
Variations to performances or events

The Seller reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating, participation, placement arrangements (including ticket categories) and audience/participation capacity.
Conditions of entry

Admission to an event is subject to the Seller's Terms. In particular, the following form part of the Seller's terms unless otherwise specified:

You may be denied entry into, or removed from, an event where the Seller has reasonable grounds to do so, including if you breach these Terms and Conditions or the Seller's Terms, or you are intoxicated, under the influence of illicit drugs, inappropriately attired/equipped or adversely affecting the enjoyment of the event by others.

If you arrive late, you may not be admitted until a suitable break in the event.
-
You may not be permitted to take into the event, or use, cameras or other photographic or recording equipment (including mobile phones).
-
You may be required to submit to a search of your person and/or possessions before entering/exiting the event.
COVID-19-specific conditions of entry
-
If you are attending the event as part of a group, as the primary ticket purchaser, you are responsible for knowing the contact details of all attendees in your group (including their full name, contact email and contact phone number). In the event you are contacted directly by the Ministry of Health for the purposes of contact tracing, you must make these details available to the Ministry of Health for that purpose.

As the primary ticket purchaser, you must download the NZ COVID Tracer app, and take responsibility for ensuring that other attendees in your group also download the NZ COVID Tracer app.

Upon arrival at the Event, you must use the NZ COVID Tracer app to scan the Event-specific QR codes. Such QR codes will be located at entry points, and around the event Venue.

All attendees in your group must commit to stopping the spread of COVID-19. Neither you nor any other members of your group will attend the Event if you are currently subject to a 14-day isolation period or feeling unwell.
Authenticity and validity of tickets

Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased from Titan Training Ground or other authorised points of sale.

Resale of tickets & scalping
-
Tickets may not, without the prior written consent of Titan Training Ground and the Seller, be resold or offered for resale at a premium (including via online auction or other unauthorised resale sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticket holder may be refused admission. Titan Training Ground and/or the Seller will take all reasonable steps to notify you of Titan Training Ground's intention to cancel the ticket or render it invalid within a reasonable time before cancelling it or rendering it invalid.
SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.
Collection and delivery of tickets

You must allow adequate time for the collection or delivery of tickets. Methods of collection and/or delivery will be available when choosing your collection/delivery details. In the interests of minimising ticket scalping, Titan Training Ground may change your delivery method to "venue collect" at its discretion.

Where concessions are applicable, suitable and valid identification must be provided for the collection of tickets and at the event.
Limitations on the number of tickets purchased

When purchasing tickets for a particular event you may be limited to a specified number of tickets. If you exceed the stated ticket limit, you may have any or all of your orders and tickets cancelled without notice by Titan Training Ground at its discretion. This includes orders associated with the same name, e-mail address, billing address, credit card number or other information. Ticket limits apply to ensure fair access to tickets for fans/participants, and as a measure to minimise ticket scalping.

Errors

While Titan Training Ground takes all reasonable care to ensure that tickets are correctly priced and only available for sale when intended, sometimes errors may occur. Titan Training Ground may cancel an order made as a result of any such error, although in the case of a pricing error Titan Training Ground will endeavour to contact you to give you the option of purchasing the ticket at the correct price.
Membership Terms and Conditions
MEMBERSHIP TERMS AND CONDITIONS AGREEMENT
PLEASE READ CAREFULLY.
Note: You may cancel this contract without penalty within 5 working days after you have received a copy of it by informing the Club in writing. We may require you to pay for the days that you have had access to the club, at our standard daily rate and for any goods you have received on joining up.
This Membership Agreement is between the Member whose details are on the membership agreement (you) and Titan Training Ground trading as Titan Training Ground head office 93 Durham Street South, Sydenham, Christchurch 8023, New Zealand. ("we, us").
USE OF THE TRAINING CENTRE:
Your membership gives you the right to use the training center during normal opening hours on the terms of this Agreement. It does not cover additional costs like food or drink, clothing, personal equipment, special classes, seminars, or personal training, which you must pay for separately. We will take all reasonable care to ensure that facilities are available during normal opening hours, but sometimes demand from other members or circumstances beyond our control such as equipment failure or the availability of staff may mean that the equipment or classes that you want to use or join may not be available.
FEES AND PAYMENTS:
You agree to pay all the payments as shown on your payment agreement. During the initial (minimum) period membership you cannot cancel your membership except as set out in these Terms and Conditions. After the initial period, payments will continue until you advise us of your cancellation of this agreement (see “How to Cancel'' below). You must continue paying even if you do not use the club. The membership rate quoted is an instalment rate and must be paid by direct debits which may be processed on or after the date due, but not before. It is your responsibility to make sure there are sufficient funds in your account. Payments are guaranteed not to increase during the initial period unless required by law. After the initial period the rate may be increased by Titan Training Ground giving you at least 30 days’ notice in writing which may be by email. If you do not wish to accept that increase you may cancel your membership but must do so before the first Direct Debit at the new rate. When payment(s) are missed, any overdue amount will be added to the next Direct Debit. All costs associated with recovery of any missed payments will be added to any amounts due. This includes a $15 administration charge, and all reasonable collection agency costs. Club rules and procedures: You must comply with training center rules and procedures at all times while using the services and facilities. These rules and procedures are designed to allow all members to get maximum benefit from their membership and may change from time to time. Copies are available at the front desk and online. You must not carry out any illegal acts on the training centres premises and you must comply with our health and safety requirements. You must respect staff and other members, and you must not take photographs, audio, or video footage in the club without our permission and the permission of every person in the photograph, audio, or video.
Termination by you: If you choose to terminate your contract within the Initial Term, then if you have a special discounted rate for agreeing to an initial term you must pay us 25 percent of the remaining balance of your membership agreement. And the retail cost of any product obtained as part of the membership agreement to cover our losses. Alternatively, you can ask us to transfer your membership to another person with our consent for the remainder of the initial term providing you pay a transfer fee of $50 plus a direct debit set up fee, providing that person complies with our usual membership requirements. Termination by us: We may terminate your membership immediately if you carry out any activity which is illegal, offensive, dangerous to other people or to you, if you act in serious breach of the training centres rules, or if at any time four or more payments are overdue. If we terminate because of your actions, we will not be liable to you in any way. Any outstanding fees may be referred to a collection agency to obtain payment from you. You are responsible for the payment of the outstanding fees along with any additional fee or charges incurred by the collection action. HOW TO CANCEL: After the initial period you may cancel your membership by informing Debit Success and Titan Training Ground in writing which may be by email. If by email, send your request to Debit Success as the main recipient and cc in Titan Training Ground. Confirmation letters/emails /texts will be sent within 10 working days of receiving a cancellation request. Cancellation will take effect from your next direct debit date that is more than 3 working days after we receive your request. Payment Holds: During the initial term you can suspend your membership and your payments as set out in the membership payment agreement. Each payment hold must be for at least 1 week with a maximum of 4 weeks per 12 month period. Your Initial Period will be extended by the length of the suspended period. After the minimum term you can suspend your membership by a maximum of 1 month in any period of 12 months of training center use. A payment hold administration fee of $10 per suspension request will apply. If you use the training center during a freeze period, your payments will restart immediately. All suspension requests require you to provide a start and finish date for the requested hold period. If a suspension is applied during the billing period then a part charge will apply for the billing period. GENERAL: We may need to make changes to this membership agreement from time to time. We will give you one month’s notice of any changes using email/text. Where we reasonably believe that a change will be detrimental to you (unless it is required by law) we will offer you the right to cancel the contract. You may have other rights under the Consumer Guarantees Act or other consumer law. It is your responsibility to use this training centre safely, to take care of your own health and to take care of your own property. Personal injury by accident in New Zealand is covered by the Accident Compensation Act. By agreeing to training with Titan Training Ground and/or by signing a membership agreement with Titan Training Ground either in writing or electronically. You agree to be bound by the terms and conditions of the membership terms and conditions agreement.

Please note that these Club Rules form part of your Titan Training Ground Membership Agreement. Rules specific to each club may be displayed on notices or at reception. They form part of these club rules and may be changed without notice. Breach of these Club Rules may result in termination or suspension of your Membership Agreement. If your Membership Agreement is terminated as a result of your breach of these Club Rules, you may also be prevented from re-joining Titan Training Ground in the future.
HEALTH, SAFETY, AND WELLBEING

You must follow Club Health and Safety instructions and requests from Titan Training Ground staff and/or officials at all times, otherwise you will be asked to leave the premises

Wearing training gear which is appropriate and comfortable to exercise in is a necessity – Muay Thai training gear is recommended and preferred. For example jeans are not appropriate as they create restriction of movement. Please be mindful and considerate of others. By not wearing anything offensive or intimidating to others. Please do not wear anything which could cause injury to yourself, another person, and/or which may damage equipment.

Please remove jewellery, headwear, eyewear, or other adornments which may be hazardous to yourself or others.
-
Do wear appropriate sports footwear. No open-toe footwear. Bare feet only in classes that require it (for example Muay Thai, Dutch Kickboxing and Yoga classes).

Please keep bags and similar items off the gym floor. Shelving and lockers are available for their storage. It’s vital that you help to maintain uninhibited access to entrances, exits, pathways and emergency exits.

Towels are compulsory in workout areas. This is for hygiene, safety, and cleanliness reasons. If you’ve forgotten your towel, you can hire or buy one at reception.

All members are required to clean up after oneself. This includes wiping down all equipment after use and disinfecting as required.

Please do not come to Titan Training Ground, the ProStore, and/or off site locations administered by Titan Training Ground or the ProStore under the influence of drugs or alcohol. Anyone who does so will be asked to leave immediately and may have their membership suspended or terminated

You are not permitted to train or coach others in our clubs, whether there is any form of payment or not.
YOUR PERSONAL BELONGINGS

It’s up to you to keep your belongings safe

It is recommended that you leave your gear in the hire lockers and use a padlock. Take your gear home every night as lockers are cleared every night once the hire period has expired (unless you have a long term locker hire agreement).

Your items which are stored in the lockers must be of a clean and hygienic state. If in our deliberation they are not. Then they will be disposed of without recompense and at your expense.

Personal items left at the club will be disposed of at the end of each night. Please take care of your personal items. They are your responsibility.
PHOTOGRAPHY, VIDEOGRAPY, AND STREAMING IN OUR CLUB(S)

Do not photograph or video anyone on club premises without the expressed prior consent of every single person who may be in the images, whether staff, coach, PTs, other members, or students.

Do not post online, broadcast, stream or publish any photo(s) or video(s) which contains an image of any person other than you or someone who has given you permission to post this image.
-
If members or guests want to use any photo or video taken on club premises for commercial purposes, they must get written permission from Titan Training Ground and the ProStores authorised personnel at Titan Training Ground and the ProStore head office.

Titan Training Ground and the ProStore staff and contractors may take photos or video recordings for the purposes of providing services to members. Where Titan Training Ground and the ProStore staff or contractors take such photos or recordings, they must abide by all relevant Titan Training Ground and the ProStore policies including our Privacy Policy and Media & Social Media Policy.

Absolutely no photos or videos in the changing rooms.
SAUNA AND POOL
If your club has a Sauna and/or Pool, these rules apply:

No phones are allowed in the Sauna or Pool Area

Please be modest, you must use a towel and appropriate wear

Do not shave or use body products in the sauna or pool

Please shower before using the sauna

Drink plenty of water
-
For your safety & for the consideration of others. Please limit your use to 20 min per use. Ensure that a medically appropriate level of time is taken between uses.

If feeling faint or dizzy, leave immediately and advise Titan Training Ground staff
-
Please seek medical advice prior to use especially if you suffer from any medical condition or are on medication.
ILLEGAL, BANNED, AND INAPPROPRIATE CONCERNS

Illegal or banned performance-enhancing substances of any kind are prohibited on or around club premises
-
Do not carry out (or attempt to carry out) any illegal activity in or near our clubs
-
Do not behave inappropriately or offensively in or near our clubs
-
Do not use abusive language or harass, insult or threaten anyone (staff, members, students, visitors or the public). We will terminate the membership of anyone who causes other members or staff genuine concern about their safety inside or outside the club (that includes emails, texts, phone calls or correspondence)
-
Action will be taken further if required. For example police or legal action.
-
Do not solicit members, staff or students or carry out any business within the club or on its surrounding site. This includes contacting members or staff by email for business purposes without their consent

Don’t promote products or services of any kind on Titan Training Ground and the ProStores property without the permission of the club manager
CHILDREN
-
Minimum age for membership is 13
-
Children (aka youth) between the ages of 13 and 17 (inclusive) require the consent of a legal guardian to become a member or to use the club facilities on a casual basis.

Children aged 13 may use the Club facilities to train with a Titan Training Ground Personal Trainer, Coach, Instructor or to participate in Titan Training Ground supervised youth appropriate exercise programmes, in each case subject to the conditions below.

Where any child aged 13 wishes to train with a Titan Training Ground Personal Trainer:

The child must have consent from a legal guardian;
-
The child's legal guardian is required to be present at the Club during all training sessions and must supervise the child at all times in the changing areas.

Children under 13 years of age are not permitted in the Club facilities other than where participating in Titan Training Ground supervised youth appropriate training programme or if not training, then under the attentive and direct supervision of an appropriate guardian of legal age.

Where any child wishes to participate in a Titan Training Ground supervised youth appropriate training programme:

The child must have consent from a legal guardian;

The child's legal guardian is required to ensure that the child understands the club rules as well as appropriate behavioural conduct during access to our clubs or when representing our clubs.

Legal guardians must ensure the safety and wellbeing of their child. While travelling to and from our clubs and also while training within our clubs or off premise sites.

From time to time Titan Training Ground will work together with schools to offer supervised school exercise programmes. The terms of any child's access and use of Club facilities for the purposes of any Titan Training Ground school programme will be as agreed between the Club and the relevant school.

Titan Training Ground and the ProStore

We ask and require that our brand, identity, and logos are respected and honoured.
-
This includes but is not limited to displaying compassion, courtesy, and consideration to others.
-
This includes but is not limited to refraining from exhibiting intimidating , threatening or abusive behaviour.

This is required when Titan Training Ground and the ProStore club wear, sports wear, street wear or uniforms which display the Titan Training Ground and the ProStore logo(s) or branding material are worn or otherwise displayed.

If you have any feedback about a service, a staff member or facility, please speak to reception and we’ll put you in touch with the appropriate manager

We may ask you to put your complaint in writing.

Subscription-Based Membership (Until Further Notice)
Contract Notice Periods:
By signing this agreement, I authorize Titan Training Ground or its agents to debit my nominated payment method at the prescribed rate and frequency for the duration of my membership. I must provide the correct written membership cancellation request form with thirty days' notice to stop these payments.
If I want to freeze my membership, I must give at least 30 days' notice and submit the correct completed freeze request form with a return/unfreezing date. The minimum freeze period is 14 days, and the maximum is 30 days per request.
Timely and correct communication is crucial. The correct forms must be requested in person at Titan Training Ground or in writing via email if necessary. Notice given via SMS, phone, verbally or via social media will not be accepted. This ensures that your requests are processed efficiently and accurately.
It is essential to understand that freezing and cancelling a membership are separate processes, and you must provide notice for each request. Suppose you wish to cancel during a membership freeze period. In that case, you must first reactivate the membership, ensure all payments are up to date, and then remain active for 30 days as per the cancellation notice policy period. This process ensures that you are fully informed and prepared for any changes to your membership.
It is imperative that you stay current with all payments. Cancelling your bank account, payment method, or credit card to avoid your financial obligations without first contacting Titan Training Ground to discuss cancelling your membership subscription will result in dishonour fees, penalties, and/or debt collection action. Follow these procedures to avoid these consequences.
It's important to understand that your absence from class or at Titan Training Ground does not affect your obligation to maintain payments during your agreed subscription period. Titan Training Ground's role is to provide classes and instruction. Therefore, you are responsible for informing Titan Training Ground or the authorized nominated agent as specified in writing by Titan Training ground and giving them the correct notice of any membership freeze or cancellation requests. This empowers you to manage your membership according to your needs.
